Welcome to Poopy. These terms and conditions explain what you can expect from us and what we expect from you. Please keep this document; you may need it later for warranty claims, returns, or questions about your Membership.

Article 1: WhatDo These Terms and Conditions Apply To?
These terms and conditions apply to all offers, orders, and agreements you Poopy with Poopy through our website. This applies to both one-time purchases (products) and our Poopy Membership our service agreement). They clarify what you can expect from us and what we expect from you.

Article 3: How Is an Order Placed?
- Your order is final as soon as we confirm it by email.
- Images on the site are indicative; colors or details may vary.
Article 4: The Poopy Membership Hardware-as-a-Service)
Are you opting for a Membership? Then these additional rules apply:
- The Model:This is a service agreement—it is explicitly not a loan or an installment purchase. You pay for the complete package: use of the machine, an unlimited warranty, and automatic delivery of litter.
- Term:You enter into a contract for 12 or 24 months. After this period, the subscription can be canceled on a monthly basis (in accordance with the Van Dam Act).
- The 28-day cycle:We charge the service fee every 4 weeks. This way, your payment always aligns with your litter usage.
- End of contract:We will, of course, inform you clearly and well in advance that the end of your fixed-term contract is approaching. We’ll help you make a decision. You have three options:Take over the unit:You pay a buyout fee of €1.00. This gives you the option to sign up for a new, affordable grit-only subscription on your own to ensure continued grit deliveries.Exchange the unit:You exchange the unit for a new model by entering into a new contract.Continue the contract:You let the contract continue on a monthly basis. If you don’t make a choice, the service will continue, but we’ll pause grit deliveries until we hear from you.
Article 4a: Paymentin Installments
- For some products, you can Membership to pay in installments instead of purchasing a Membership . You can then pay in 2, 3, 6, or 12 monthly installments. The full terms and conditions for this are set out in the Installment Payment Addendum, which forms part of these terms and conditions.
- You can find the Addendum atpoopy.co/pages/terms-of-installment-payment. With each installment payment, we’ll include the Addendum as a PDF in your welcome email.
ArticlePoopy : PoopyEssentials
- With a Poopy Essentials , you’ll receive Poopy(Fusion Mineral) at home on a regular basis. You choose how often: every 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, or 14 weeks. We automatically charge each delivery via SEPA.
- An Essentials is a rolling contract. You can cancel at any time under the Wet van Dam, with no minimum contract period. Your cancellation will take effect as of the next delivery date.
- For every delivery, the statutory right of withdrawal applies for 14 days after receipt. In addition, our Poopy applies, as described in Article 7.
- If we are unable to collect a payment, we follow the same step-by-step procedure as with other subscription plans: a friendly reminder, a standard 14-day notice, and finally a formal termination, at which point we cancel the subscription and declare the outstanding amount due and payable.

Article 5: WhatDo You Pay and How?
- Prices include VAT.
- One-time purchase:You become the owner as soon as full payment is received.
- Membership:You pay per 28-day cycle via direct debit. For pre-orders, the first payment amount may vary (see your order confirmation).
- Indexation:Because the costs of litter and transportation may increase, we may adjust the price of the Membership by up to 10% Membership .
Article 6: Whendo we deliver?
- We deliver to the address you provided.
- If that is not possible, you may cancel free of charge and receive a refund.
Article 7: Whatif you want to return your purchase?
- Trial Period:You have 101 days (50 days if you purchase a Poopy separately and immediately). For the litter box, you can actually let your cat test it out (by pooping in it).
- Let's be honest:The right to a 101-day trial period applies only once per household. We want to prevent abuse (such as "trial-hopping").
- Returned sparkling clean:Since we want to get the litter boxes ready for the next cat, the Poopy must be Poopy cleaned and returned to us in its entirety.
- Dirty Return Fee:Is the container dirty or does it contain litter residue? If so, we'll deduct cleaning fees from your refund or deposit.
- Hygiene products:Sealed products (bags, filters, litter) can only be returned if the seal is still intact. For Membership, opened consumables will be deducted from your credit.
Article 8: Whatif your product arrives broken (DOA)?
- Report this within 48 hours of receipt.
- We will send a new product free of charge or refund you, including return shipping costs.
Article 9: What about the warranty?
- No warranty for damage caused by pet behavior, incorrect installation, or blocked updates.
- The motor, sensors, and electronics of your Poopy a 2-year warranty. Consumable parts are not covered by the warranty. The litter Rule: Using a different type of litter will void your warranty.
- The litter Rule:The Poopy a precision machine calibrated for Poopy . If you use a different type of litter (e.g., one that’s too coarse) and the machine breaks as a result, your warranty will be void and you’ll be responsible for the repair costs.
- Consumables (including, but not limited to: collection bags, filters, inner floors, litter mats, drinking fountains) are not covered by the warranty.
Article 10: How to Use Our Products Safely?
- Use only litter recommended by Poopy .
- Weight limit:The Poopy only suitable for cats weighing 1 kg or more. Use with lighter kittens is at your own risk due to the safety sensors.
- Use only the original Poopy and place the unit on a dry, stable surface.
- We are not liable for damage caused by use that contravenes these regulations.
Article 11: Force Majeure
Sometimes things happen that are beyond our control, such as strikes, natural disasters, disruptions at suppliers or carriers, government measures, or pandemics. In such cases, we may have to delay delivery or may be unable to fulfill an agreement. We’ll let you know as soon as possible and work with you to find a solution.
Article 12: WhenDoes the Product Truly Belong to You?
- Single purchase:As soon as full payment is received.
- Membership:The unit remains the property of Poopy. Only after you pay the buyout fee of €1.00 at the end of your contract period will ownership be transferred to you.
- The Buyout:After paying the €1.00, you purchase the machine in its current condition (“as-is”). From that moment on, the right of withdrawal applies only to new litter deliveries, and no longer to the machine. You now have the option to sign up for a new litter-only subscription.
- Prohibition on Resale:Until you are the official owner, you may not resell, rent out, or give away the unit.
Article 13: What Happens If You Don't Pay During Your Membership
- Since Poopy Poopy Poopy Poopy , we have the right to suspend service if you don’t pay. Before that happens, we’ll first follow the steps required by law: a friendly reminder, a formal 14-day notice, and finally, a notice of default.
- Are you more than 45 days behind on your payments and haven't responded to our letters? If so, we'll terminate your Membership ask you to return the Poopy to us Poopy 14 days. We'll send you a free return label for this purpose.
- The full remaining service fee through the end of the minimum contract period will then become immediately due and payable.
- If you Poopy return the Poopy within 14 days, we will charge Poopy the replacement value of the Poopy , which is equal to the cash retail price of the current model. In addition, we will charge a €75 administrative fee to process your case.
Article 14. Amendmentof Terms and Conditions
Yes, we can adjust these terms and conditions for future orders. The date at the top shows when the last change was made. We will inform you of any significant changes via our website or by email.
Article 15 Liability
- Our liability for damages is limited to the amount you paid for the product, to the extent permitted by law.
- We are not liable for indirect damages, such as consequential damages or lost profits.
Article 16: Software and Updates
- Data stuff:We collect data about how the machine is used to improve our service, schedule litter deliveries, and prevent malfunctions. Read ourPrivacy Statementto learn how we protect your data.
- Updates:We may automatically update software and firmware to Poopy the security and performance of the Poopy .
Article 16a: Contact by Telephone
Poopy contact you by phone regarding products and services related to your previous purchase. We will only do this if you have given your prior consent via the opt-in during the ordering process. You can withdraw this consent at any time by contacting us at support@poopy.co or by indicating this during a phone call. See ourPrivacy Policyfor more information on how we process your data.
Article 17: Resaleand International Orders
- The sale of used Poopy as new is not permitted.
- Delivery outside the Netherlands may incur additional costs, such as import duties, VAT, and customs fees.
Article 18: Abuse and Fraud
In case of suspected fraud, abuse of the right of return, or excessive returns, we reserve the right to refuse orders or cancel future orders.
Article 19: Complaintsand Disputes
19.1If you have a complaint about a product, a delivery, an installment payment, or our services, please send us an email topoopy within 2 months of discovering the issue. We always try to resolve your complaint together with you first.
19.2If the parties are unable to resolve the matter among themselves, you may submit your dispute to the competent Dutch court. This agreement is governed by Dutch law.
19.3Do you live in another EU country? If so, the consumer protection laws of your own country will still apply, even though it is stated above that Dutch law applies. You may also bring a dispute before a court in your country of residence instead of a Dutch court. This is provided for in an EU regulation that protects your rights no matter where you live in the EU (the Brussels I bis Regulation).
19.4 EU Dispute Resolution Platform.If we are unable to resolve the issue together, you can turn to the European Online Dispute Resolution Platform athttps://ec.europa.eu/consumers/odr/. We can usually resolve the issue more quickly and with a more personalized approach if you email us first atpoopy.
