What do these terms and conditions apply to?

These terms and conditions apply to all offers, orders, and agreements you Poopy with Poopy via our website. This applies to both individual purchases (products) and our Poopy Membership (our service agreement). They clarify what you can expect from us and what we expect from you.

How does an order come about?

  • Your order is final as soon as we confirm it by email.
  • Images on the site are indicative; colors or details may vary.

The Poopy Membership Hardware-as-a-Service)

Are you opting for a Membership? Then these additional rules apply:

  • The model: This is a service agreement, explicitly not a loan or hire purchase. You pay for the complete package: use of the machine, unlimited warranty, and automatic delivery of grit.
  • The term: You enter into a contract for 12 or 24 months. After this period, the subscription can be canceled on a monthly basis (in accordance with the Wet van Dam).
  • The 28-day cycle: We collect the service fee every 28 days. This means there are 13 installments per year. This way, your payment always matches your grit consumption.
  • End of contract: After your fixed term, you have the choice: take over the unit for a buyout fee of €1, exchange the unit for a new model, or continue the contract on a monthly basis. If you don't make a choice, the service will continue, but we will pause the grit delivery until we hear from you.

What do you pay and how?

  • Prices include VAT.
  • Individual purchase: You become the owner as soon as payment has been received in full.
  • Membership: You pay every 28 days via direct debit. For pre-orders, the first payment may differ (see your order confirmation).
  • Indexation: Because the costs of grit and transport may increase, we may adjust the price of the Membership by a maximum of 10% Membership .

When do we deliver?

  • We deliver to the address you provided.
  • If that is not possible, you may cancel free of charge and receive a refund.

What if you want to get rid of your purchase?

  • Reflection period: You have 50 days (30 days in the case of Membership). For the litter box, you can have your cat test it out (try it out).
  • To be fair: The right to a 50-day trial period applies once per household. We want to prevent abuse (such as "trial hopping").
  • Sparkling clean: Because we want to clean the litter boxes thoroughly for the next cat, the Poopy must be Poopy cleaned and returned to us in perfect condition.
  • Dirty Return Fee: Is the container dirty or does it contain grit residue? If so , we will deduct €75 in cleaning costs from your refund or deposit.
  • Hygiene products: Sealed products (bags, filters, grit) can only be returned if the seal is still intact. For Membership, opened consumables will be charged.

What if your product arrives broken (DOA)?

  • Report this within 48 hours of receipt.
  • We will send a new product free of charge or refund you, including return shipping costs.

What about warranty?

  • No warranty for damage caused by pet behavior, incorrect installation, or blocked updates.
  • You have a 2-year legal warranty on the motor, sensors, and electronics. With a Membership , you Membership unlimited warranty for as long as your contract runs.
  • The Grit Rule: The Poopy a precision machine that is calibrated for Poopy . If you use other grit (e.g., grit that is too heavy) and the machine breaks down as a result, your warranty will be void and you will be responsible for the repair costs.
  • Consumables (including, but not limited to: collection bags, filters, inner floors, grit mats, drinking fountains) are not covered by the warranty.

How do you use our products safely?

  • Use only grit recommended by Poopy .
  • Weight limit: The Poopy only suitable for cats weighing 1.5 kg or more. Use with lighter kittens is at your own risk (due to the safety sensors).
  • Only use the original Poopy and place the unit on a dry, stable surface.
  • We are not liable for damage caused by use that contravenes these regulations.
  • Use on a dry, stable surface.

What if something happens that is beyond our control (force majeure)?

Sometimes things happen that are beyond our control, such as strikes, natural disasters, disruptions at suppliers or carriers, government measures, or pandemics. In such cases, we may deliver later than expected or be unable to fulfill an agreement. We will let you know as soon as possible and work with you to find a solution.

When does the product truly become yours?

  • Individual purchase: As soon as full payment has been received.
  • Membership: The unit remains the property of Poopy. Only when you pay the buyout fee of €1 after your contract period does ownership transfer to you.
  • The Buyout: After paying the €1, you purchase the machine in its current condition ("as-is"). From that moment on, the right of withdrawal only applies to new grit deliveries, not to the machine itself.
  • Prohibition on resale: Until you are the official owner, you may not resell, rent out, or give away the unit.

Special situations regarding Membership

Non-payment: Because the machine belongs Membership us under a Membership , we may discontinue the service if you do not pay. Are you more than 45 days behind on your payments? Then we will consider this to be misappropriation of our property and the full residual value of the machine will become immediately due and payable.

Can these terms and conditions change?

Yes, we can adjust these terms and conditions for future orders. The date at the top shows when the last change was made. We will inform you of any significant changes via our website or by email.

What about liability?

  • Our liability for damages is limited to the amount you paid for the product, to the extent permitted by law.
  • We are not liable for indirect damages, such as consequential damages or lost profits.

What about software or updates?

  • Data poop: We collect data about the use of the machine (such as the number of visits) to improve our service, plan grit deliveries, and prevent defects. You can read exactly how we protect your data in our Privacy Statement.
  • Updates: We may automatically update software and firmware to Poopy the safety and functionality of the Poopy .

What if you resell or use our products secondhand?

  • Selling used Poopy as "new" is not allowed.
  • We are not liable for damage or defects in second-hand use outside of Poopy .

What if you order internationally?

  • Delivery outside the Netherlands may incur additional costs, such as import duties, VAT, and customs fees.
  • Any delay due to customs is beyond our responsibility.

What if someone abuses returns or orders?

  • In case of suspected fraud, abuse of the right of return, or excessive returns, we reserve the right to refuse orders or cancel future orders.

What about data and technical failures?

  • We do everything we can to ensure that our products and software work properly, but we are not liable for indirect damage caused by data loss or technical malfunctions, unless this is the result of intent or gross negligence on our part.

What if you have a complaint?

  • Report your complaint within 2 months of discovery viapoopy.
  • You will receive a substantive response within 14 days.

And in the event of a dispute?

Our agreements are governed by Dutch law. The Vienna Sales Convention does not apply.
