Terms and conditions

1. Where do these terms and conditions apply?
These terms and conditions apply to all offers, orders, and agreements you Poopy with Poopy via our website. This applies to both individual purchases (products) and our Poopy Membership our service agreement). They clarify what you can expect from us and what we expect from you.
2. Who are we?

3. How is an order placed?
- Your order is final as soon as we confirm it by email.
- Images on the site are indicative; colors or details may vary.
4. The Poopy Membership Hardware-as-a-Service)
Are you opting for a Membership? Then these additional rules apply:
- The model: This is a service agreement, explicitly not a loan or hire purchase. You pay for the complete package: use of the machine, unlimited warranty, and automatic delivery of grit.
- The term: You enter into a contract for 12 or 24 months. After this period, the subscription can be canceled on a monthly basis (in accordance with the Wet van Dam).
- The 28-day cycle: We charge the service fee every 4 weeks. This way, your payment always aligns with your grit usage.
- End of contract: We will, of course, inform you clearly and in good time that the end of your fixed contract period is approaching. We will help you make a choice. You have three options:Take over the unit: You pay a buyout fee of €1.00. This gives you the option of taking out a new, affordable grit-only subscription yourself to ensure you continue to receive grit deliveries.Exchange the unit: You exchange the unit for a new model by entering into a new contract.Continue: You allow the contract to continue on a monthly basis. If you do not make a choice, the service will continue, but we will pause the grit delivery until we hear from you.
4a. Paying in installments
- For some products, you can Membership to pay in installments instead of purchasing a Membership . You can then pay in 2, 3, 6, or 12 monthly installments. The full terms and conditions for this are set out in the Installment Payment Addendum, which forms part of these terms and conditions.
- You can find the Addendum at poopy.co/pages/terms-of-payment-by-installments. With each installment payment, we’ll include the Addendum as a PDF in your welcome email.
4b. Poopy Essentials
- With a Poopy Essentials , you’ll receive regular deliveries of Poopy(Fusion or Mineral) right to your door. You choose the delivery frequency: every 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, or 14 weeks. We automatically charge each delivery via SEPA.
- An Essentials is a rolling contract. You can cancel at any time under the Wet van Dam, with no minimum contract period. Your cancellation will take effect as of the next delivery date.
- For every delivery, the statutory right of withdrawal applies for 14 days after receipt. In addition, our Poopy applies, as described in Article 7.
- If we are unable to collect a payment, we follow the same step-by-step procedure as with other subscription plans: a friendly reminder, a standard 14-day notice, and finally a formal termination, at which point we cancel the subscription and declare the outstanding amount due and payable.

5. What do you pay and how?
- Prices include VAT.
- Individual purchase: You become the owner as soon as payment has been received in full.
- Membership: You pay per 28-day cycle via direct debit. For pre-orders, the first installment may differ (see your order confirmation).
- Indexation: Because the costs of grit and transport may increase, we may adjust the price of the Membership by a maximum of 10% Membership .
6. When do we deliver?
- We deliver to the address you provided.
- If that is not possible, you may cancel free of charge and receive a refund.
7. What if you want to return your purchase?
- Reflection period: You have 101 days (50 days in the case of a separate and direct purchase of a Poopy). For the litter box, you can have your cat test it out (try it out).
- To be fair: The right to a 101-day trial period applies once per household. We want to prevent abuse (such as "trial hopping").
- Sparkling clean: Because we want to clean the litter boxes thoroughly for the next cat, the Poopy must be Poopy cleaned and returned to us in perfect condition.
- Dirty Return Fee: Is the container dirty or does it contain grit residue? If so, we will deduct cleaning fees from your refund or deposit.
- Hygiene products: Sealed products (bags, filters, grit) can only be returned if the seal is still intact. For Membership, opened consumables will be charged.
8. What if your product arrives broken (DOA)?
- Report this within 48 hours of receipt.
- We will send a new product free of charge or refund you, including return shipping costs.
9. What about the warranty?
- No warranty for damage caused by pet behavior, incorrect installation, or blocked updates.
- The motor, sensors, and electronics of your Poopy a 2-year warranty. Consumable parts are not covered by the warranty. The Grit Rule: Using a different type of grit will void your warranty.
- The Grit Rule: The Poopy a precision machine that is calibrated for Poopy . If you use other grit (e.g., grit that is too heavy) and the machine breaks down as a result, your warranty will be void and you will be responsible for the repair costs.
- Consumables (including, but not limited to: collection bags, filters, inner floors, grit mats, drinking fountains) are not covered by the warranty.
10. How do you use our products safely?
- Use only grit recommended by Poopy .
- Weight limit: The Poopy only suitable for cats weighing 1.5 kg or more. Use with lighter kittens is at your own risk due to the safety sensors.
- Only use the original Poopy and place the unit on a dry, stable surface.
- We are not liable for damage caused by use that contravenes these regulations.
11. Force majeure
Sometimes things happen that are beyond our control, such as strikes, natural disasters, disruptions at suppliers or carriers, government measures, or pandemics. In such cases, we may deliver later than expected or be unable to fulfill an agreement. We will let you know as soon as possible and work with you to find a solution.
12. When does the product truly become yours?
- Individual purchase: As soon as full payment has been received.
- Membership: The unit remains the property of Poopy. Only when you pay the buyout fee of €1.00 after your contract period does ownership transfer to you.
- The Buyout: After paying the €1.00, you purchase the machine in its current condition ("as-is"). From that moment on, the right of withdrawal only applies to new grit deliveries, not to the machine itself. You now have the option to take out a new grit-only subscription.
- Prohibition on resale: Until you are the official owner, you may not resell, rent out, or give away the unit.
13. What if you don't pay during your Membership
- Since Poopy Poopy , we have the right to suspend service if you don’t pay. Before that happens, we’ll first follow the steps required by law: a friendly reminder, a formal 14-day notice, and finally a notice of default.
- Are you more than 45 days behind on your payments and haven’t responded to our letters? If so, we’ll terminate your Membership ask you to return the Poopy to us Poopy 14 days. We’ll send you a free return label for this purpose.
- The full remaining service fee through the end of the minimum contract period will then become immediately due and payable.
- If you Poopy return the Poopy within 14 days, we will charge Poopy the replacement value of the Poopy , which is equal to the current retail price of the model. In addition, we will charge a EUR 75 processing fee to handle your case.
14. Changes to terms and conditions
Yes, we can adjust these terms and conditions for future orders. The date at the top shows when the last change was made. We will inform you of any significant changes via our website or by email.
15. Liability
- Our liability for damages is limited to the amount you paid for the product, to the extent permitted by law.
- We are not liable for indirect damages, such as consequential damages or lost profits.
16. Software and updates
- Data poop: We collect data about the use of the machine to improve our service, plan grit deliveries, and prevent defects. You can read how we protect your data in our Privacy Statement.
- Updates: We may automatically update software and firmware to Poopy the safety and functionality of the Poopy .
16a. Contact by telephone
Poopy contact you by telephone about products and services that are related to your previous purchase. We will only do this if you have given your prior consent via the opt-in during the ordering process. You can withdraw this consent at any time by contacting us at poopy or by indicating this during a telephone conversation. See our Privacy Policy for more information about how we process your data.
17. Resale and international ordering
- Selling used Poopy products as new is not permitted.
- Delivery outside the Netherlands may incur additional costs, such as import duties, VAT, and customs fees.
18. Abuse and fraud
In case of suspected fraud, abuse of the right of return, or excessive returns, we reserve the right to refuse orders or cancel future orders.
19. Complaints and disputes
- Report your complaint within 2 months of discovery at poopy
- Our agreements are governed by Dutch law. The Vienna Sales Convention does not apply.
